Terms of Service and Privacy

This application (the "App") is operated by Do Moore Good ("DMG") to support its volunteer pardon-assistance program in the Commonwealth of Pennsylvania. By logging in or otherwise accessing the App, you ("you" or "User") agree to the terms below. If you do not agree, do not access or use the App.
1. Confidentiality of applicant information
The App contains sensitive personal information about individuals seeking pardons, including (without limitation) identifying information, criminal-history records, contact information, financial details, and personal narratives ("Applicant Data"). You agree to treat all Applicant Data as strictly confidential. You will:
- Access Applicant Data only as needed to perform your role within the DMG pardon program.
- Not disclose, share, forward, copy, photograph, screenshot, print, export, or otherwise transmit Applicant Data to any person who is not authorized by DMG to receive it.
- Not use Applicant Data for any purpose other than supporting the applicant's pardon process through DMG.
- Not provide your login credentials, magic-link sign-in emails, or session access to any other person, and not allow any other person to use the App under your account.
- Store and view Applicant Data only on devices you personally control, that are protected by a password, passcode, biometric, or equivalent lock, and that are kept reasonably secure against loss, theft, and unauthorized access.
- Promptly notify DMG (at the contact address provided to you by DMG) of any actual or suspected loss, theft, unauthorized access, unauthorized disclosure, or other compromise of Applicant Data or of your account.
2. User responsibility for breaches and misuse
You are solely responsible for your use of the App and for any access to, disclosure of, or misuse of Applicant Data that occurs through your account, your devices, or your actions or omissions, whether intentional or negligent. This includes, without limitation, disclosures resulting from sharing credentials, leaving devices unattended or unlocked, using unsecured networks, forwarding emails containing Applicant Data, or saving Applicant Data outside the App without authorization. You agree to cooperate fully with DMG in investigating and responding to any incident involving your account or your handling of Applicant Data.
3. No warranty
THE APP AND ALL CONTENT, DATA, AND FUNCTIONALITY MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. DMG DOES NOT WARRANT THAT THE APP WILL BE SECURE, FREE OF VULNERABILITIES, OR FREE OF UNAUTHORIZED ACCESS BY THIRD PARTIES.
4. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DMG, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, OR AGENTS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO (a) your use of or inability to use the App, (b) any unauthorized access to, disclosure of, alteration of, or loss of Applicant Data or other data, (c) any data breach, security incident, malware, phishing, or other compromise affecting the App or your account, or (d) any conduct or content of any third party using the App, regardless of the legal theory and regardless of whether DMG has been advised of the possibility of such damages.
5. Indemnification
You agree to defend, indemnify, and hold harmless DMG, its directors, officers, employees, volunteers, contractors, and agents from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your access to or use of the App, (b) your violation of these Terms, (c) your violation of any law or of the rights of any third party, including any applicant whose data you access through the App, or (d) any unauthorized disclosure, loss, or misuse of Applicant Data resulting from your acts or omissions, your account, or your devices.
6. AI-assisted evaluation
The App uses Google Cloud's Vertex AI service (the Gemini family of models hosted on Vertex AI) to help summarize and evaluate applicant information, including intake responses and uploaded court documents. When a User triggers an AI feature, the relevant Applicant Data is sent to Vertex AI through Do Moore Good's private Google Cloud project so that a response can be generated and returned to the App. Under Google's Vertex AI terms, customer prompts, inputs, and outputs are not used to train Google's foundation models, are not shared with other Google customers, and are not made publicly available. The App stores AI-generated outputs only within Do Moore Good's own database, subject to the same access controls and confidentiality obligations as the rest of the Applicant Data. AI-generated summaries and scores are decision-support tools only and are not a substitute for independent human review.
7. Privacy
Applicant Data is collected and stored solely to administer the DMG pardon-assistance program. DMG limits access to authorized volunteers, hub managers, and administrators on a need-to-know basis through role-based permissions within the App. DMG does not sell Applicant Data and does not share it with third parties except (a) with the applicant's consent, (b) with service providers acting on DMG's behalf and subject to confidentiality obligations, or (c) where required by law or legal process. Applicants and Users may contact DMG to request access to or correction of their own information held in the App.
8. Termination
DMG may suspend or terminate your access to the App at any time, with or without notice, for any reason, including any actual or suspected violation of these Terms. Sections 1 through 5 and Section 7 survive termination.
9. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
10. Changes
DMG may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the updated Terms.
